Terms of Sale

Welcome to Bella Rugs. These Terms of Sale ("Terms") govern the purchase of products from Bella Rugs ("Company", "we", "us", or "our"), a company organized and existing under the laws of the State of Florida, United States.

By placing an order with us, you ("Customer" or "you") agree to be bound by these Terms. Please read them carefully before making a purchase. If you do not agree to these Terms, please do not place an order.

1. General Provisions

These Terms apply to all sales of rugs and related products through our website. We reserve the right to revise these Terms at any time. The Terms in effect at the time you place your order will apply to your purchase.

2. Product Information & Availability

2.1. Product Descriptions

We strive to display the colors, features, specifications, and details of our products as accurately as possible. However, we cannot guarantee that your electronic display will accurately reflect the actual colors and details of the products. Slight variations in color and texture are inherent to textile products and are not considered defects.

2.2. Availability

All orders are subject to product availability. If an item is out of stock after your order is placed, we will notify you immediately and refund the full amount paid for that item.

3. Pricing and Payment

3.1. Prices

All prices are displayed in the currency selected on our website (e.g., USD, EUR). Prices do not include shipping costs, taxes, or duties unless expressly stated otherwise.

3.2. Taxes and Duties

For International Customers (Outside the USA): You are responsible for any VAT, tariff, duty, taxes, handling fees, customs clearance charges, etc., required by your country for importing consumer goods. We do not collect this beforehand, and we cannot give you an estimate of the cost because it varies widely around the world.

3.3. Payment Methods

We accept major credit cards (Visa, MasterCard, American Express), PayPal, and other digital payment methods as displayed at checkout. Payment must be received in full before products are shipped.

4. Order Acceptance and Cancellation

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. If we cancel an order after you have been billed, we will refund the billed amount.

5. Shipping and Delivery

Shipping terms, including estimated delivery times and costs, are governed by our Shipping Policy, which is incorporated into these Terms by reference. Title and risk of loss for all products ordered by you shall pass to you on our delivery to the shipping carrier.

6. Right of Withdrawal (EU Customers Only)

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us at support@bellarugs.com of your decision to withdraw from this contract by an unequivocal statement.

Effects of Withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us). You will have to bear the direct cost of returning the goods.

7. Returns and Refunds (Non-EU & General)

For customers outside the EU or for situations not covered by the statutory right of withdrawal:

• Items may be returned within 30 days of delivery.
• Items must be in new, unused condition with original packaging.
• Return shipping costs are the responsibility of the customer unless the item is defective or incorrect.

8. Warranty Disclaimer

To the fullest extent permitted by applicable law, Bella Rugs provides products "as is" and disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

In no event shall Bella Rugs be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your purchase or use of the products. Our total liability to you for any damages shall not exceed the amount you paid for the product.

10. Governing Law and Dispute Resolution

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

Any dispute relating in any way to your visit to our website or to products you purchase from us shall be submitted to confidential arbitration in Florida, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court in the State of Florida.

For EU Consumers:

Nothing in these Terms shall deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law of the country where you have your habitual residence. The European Commission provides a platform for Online Dispute Resolution (ODR), which you can access at http://ec.europa.eu/consumers/odr/.
